APPEAL APPLICATION TO IPT
You can make an appeal to the Immigration and Protection Tribunal (IPT) in New Zealand if your visa application has been declined by the immigration authorities. The appeal must be made within 20 working days of the date of the immigration decision. This means that you have 20 working days from the date of the decision to submit your appeal to the IPT.
What is the process for making an appeal to the IPT?
Prepare the appeal: You need to provide a written statement that outlines the reasons why you believe the immigration decision was incorrect, and why you believe the IPT should reverse the decision. You should also include any new evidence or information that supports your case.
Submit the appeal: The appeal must be submitted to the IPT within 20 working days of the date of the immigration decision. The appeal can be submitted online, by mail, or in person.
Pay the fee: There is a fee associated with making an appeal to the IPT. The fee must be paid at the time of submission of the appeal.
Attend the hearing: The IPT will schedule a hearing for your appeal, at which you and any witnesses will be able to present your case in person. The IPT will also consider written evidence and submissions from both parties.
Wait for the decision: The IPT will make a decision based on the evidence presented at the hearing. The decision may take several weeks or months.
Consider further options: If the IPT decides against your appeal, you may be able to appeal to a higher court, or reapply for a visa under different circumstances.
It’s advisable to seek professional immigration advice and legal representation to ensure that your appeal is properly prepared and presented to the IPT.
