Are there any exemptions for character concerns related to the Migrant Exploitation Protection Visa (MEPV)?

As outlined in Immigration instructions A5.45.5:

“Any false, misleading or forged statement, information, evidence or submission, or the withholding of material information provided in the course of applying for a New Zealand visa may be disregarded where…an immigration officer is satisfied it is connected to a report of exploitation made to the Ministry of Business, Innovation and Employment (MBIE), and MBIE has assessed that it is credible that exploitation may have occurred.”

In the context of evaluating an application for an MEPV, immigration officers must disregard instances where false, misleading, forged, or withheld information is connected to the applicant’s exploitation experience. This also extends to any periods during which the applicant worked in violation of the conditions outlined by the employer who allegedly exploited them, or any periods of unlawful activity that are associated with the exploitation report.
